RHOBH Star Erika Jayne Could Lose A Million Dollars If Tom Girardi Is Convicted of Fraud Plus, Erika Comments On Tom Being Found Competent to Stand Trial

RHOBH star Erika Jayne is at risk of losing at least one million dollars in her divorce from estranged husband, Tom Girardi, amid his legal issues.

Tom Girardi’s legal woes are once again affecting his estranged wife Erika Jayne. Currently, the once famed lawyer is in the middle of a criminal fraud trial and was recently found competent to stand trial despite claiming he has dementia. 

While many Real Housewives of Beverly Hills fans have speculated about Erika’s possible involvement in Tom’s alleged fraud, there has been zero evidence tying her to his crimes. 

Still, Erika did file for divorce from Tom in November 2020, just a month before he was criminally charged for embezzling settlement funds from the clients of his Girardi Keese law firm. 

Since 2020, the criminal charges against Tom and his subsequent bankruptcies in 2021 have halted Erika and Tom’s divorce proceedings.

However, now The U.S. Sun reports that Erika could face even more losses when it comes to her divorce from Tom if he gets convicted of fraud. And it’s currently not looking great for the former attorney. 

If Tom is convicted of fraud, it will affect the RHOBH star’s wallet. According to lawyer Ronald Richards, Erika could loose one million dollars on top of “exempt property payouts from the bankruptcy estate.” 

“Her divorce has been sitting on ice since 2021. They’re doing nothing in that case,” Richards explained. “She is set to get half of whatever remains after the bankruptcy case, some things are exempt and there are community assets. But if he’s convicted a restitution order could attack whatever is left, and she could lose out, as well as be on the hook for lifetime alimony payments.”

Basically, if there was theoretically any money left after the bankruptcy case, that doesn’t take into account the restitution Tom may have to pay if convicted of fraud. 

Richards noted that Erika was “not happy” Tom was found competent to stand trial. 

Meanwhile, Erika appeared on the January 17 episode of Watch What Happens Live With Andy Cohen

During the appearance, Andy Cohen asked the RHOBH star, ” Do you still speak to him?” referencing her estranged husband, Tom. 

“No,” Erika replied.

The RHOBH star continued, “I thought I told you this, the day I euthanized my dog [Tiago in October] that was the last day. I couldn’t take it. I was literally holding my dog. He was dying in my arms and Tom kept calling. I was like, ‘I can’t do this any long.’ That was it.” 

Andy followed up, stating, “I haven’t spoken to you since Tom was ruled fit to stand trial, what is your reaction?” 

“Competent under the law, I’m not sure what the bar is,” Erika quipped. “I can only speak for what I know and what I lived, which is completely different.” 

“Do you think he is competent to stand trial?” Andy asked, to which the RHOBH star replied, “I don’t know. I’m not a lawyer.”
