Illinois Court Dismisses Erika Jayne From Fraud and Embezzlement Lawsuit Against Tom Girardi; Lawyers Re-File Charges in California

Erika Jayne may have won a battle but she’s still fighting a war.

Over the weekend, an Illinois court dismissed Erika from the fraud and embezzlement lawsuit against her estranged husband, Tom Girardi.

“Pursuant to stipulation, plaintiff’s claims against defendants EJ Global LLC and Erika Girardi are dismissed without prejudice and without costs,” read court documents filed in the Northern District of Illinois on Saturday, January 29.

Some Real Housewives of Beverly Hills fans quickly celebrated the legal victory, however, it was quickly revealed that the same charges were going to be re-filed against Erika in California.

This move is being made to “avoid fights over jurisdiction,” according to attorney Jay Edelson, who filed the lawsuit in Illinois against Tom in 2020.

“Nah. We dismissed to refile in California to avoid needless motion practice on jurisdiction. No way are we letting this go. (But as we told the court, we are exploring settlement. Every dollar will go to the victims),” Edelson tweeted.

He continued, “The suit is being refiled in California (to avoid fights over jurisdiction). No chance we are letting @erikajayne off the hook, especially given the evidence we have found. All money will go fully to the victims until they are made whole.”

 

Attorney Ronald Richards, who infamously made it his goal to link Erika to Tom’s alleged crimes, also chimed in.

“Dismissal entered against Erika Girardi in the Illinois action. This means that within minutes, Plaintiffs can upload a new action on the Fed. Docket in CA and commence a 3rd lawsuit on her. We would not be surprised if this happens within the next 48 hours,” he shared.

Richards also addressed the “fake news” that Erika was “exonerated from all claims.”

Erika’s lawyer Evan Borges released a statement to Page Six about the news and claimed victory for his client.

“I’d like to see Edelson and everyone else take the high road going forward and not make accusations against Erika without evidence,” Borges said.

“We want Edelson to get the most complete picture of the evidence as possible, and have no issue with further investigation. But the truth matters. Here, the truth is that Erika had no role in the Lion Air dealings, actions, or inaction as between the attorneys and their clients, and she never received any of the Lion Air client settlement funds.”

Borges noted that Edelson can re-file the charges against Erika in California however he added that Erika’s dismissal  “from the federal lawsuit that triggered bankruptcies of Girardi Keese and Tom Girardi is extremely important.”

RHOBH is expected to return to Bravo in Spring 2022.
