The hits just keep coming for disgraced attorney Tom Girardi.
According to Radar Online, Erika Jayne’s estranged husband will NOT wipe his debts clean with his involuntary Chapter 7 bankruptcy.
Court documents reveal that the judge presiding over Tom’s case ruled that the once famed lawyer cannot discharge his debts in his bankruptcy.
Tom’s now-defunct law firm, Girardi Keese, is currently in the middle of its own pending Chapter 7 bankruptcy case.
According to the judge, Tom’s bankruptcy case was dismissed due to two legal statutes.
The Real Housewives of Beverly Hills husband is accused of having “concealed, destroyed, mutilated, falsified, or failed to keep or preserve any recorded information, including books, documents, records, and papers, from which the debtor’s financial condition or business transactions might be ascertained.”
This means that Tom’s financial records were a mess, and as a result, the trustee overseeing the bankruptcy was unable to manage the estate.
The judge also noted that Tom failed to explain the “loss of assets or deficiency of assets to meet the debtor’s liabilities.” Basically, Tom can’t explain where the money he should have had in his possession went.
Now, Tom’s creditors can now start going after the once famed lawyer. The creditors do NOT have to go through the federal courts and can find alternative ways to seize Tom’s assets.
As for Erika, she is demanding damages from Tom and his law firm, saying they both caused her harm. She’s also complaining about Tom’s victims coming after her money as she believes it to be unfair.
The reality TV star is also reminding the court that she and Tom do not have a prenup. Because of this, she wants 1/2 of whatever is left over after Tom’s victims get paid out.
RHOBH is expected to return to Bravo in Spring 2022.
