Erika Girardi‘s estranged husband, Tom Giardi, is having some major health issues, according to his brother, Robert Girardi, a Seal Beach dentist.
According to the Los Angeles Times, Robert claims that Tom suffers from short-term memory loss amid his various legal battles. He also insists that Tom does not “understand the gravity of the legal and financial peril that he currently faces.”
Robert also says that Tom needs a conservatorship and requests that he be given control of his brother’s finances to help the bankruptcy court gain access to Tom’s financial records amid the lawyer’s Chapter 7 bankruptcy case.
“My brother is incapable of realizing and understanding the repercussions of the bankruptcy filings pending against him and his law firm Girardi Keese notwithstanding having [it] explained to him over and over and by various people,” Robert said. “Furthermore, my brother is not capable of making rational decisions with respect to his financial responsibilities and offers solutions and opinions that are factually impossible.”
In December, various creditors forced Tom and his Girardi Keese law firm into involuntary bankruptcy. Matters were made worse after Tom failed to file a response by the Tuesday deadline.
Robert’s recent petition to the court attempted to explain the reasoning behind Tom’s failure to meet the deadline. He also begged the judge for more time to mount a defense for his brother.
The dentist also told the judge that he would be filing a separate request with the Los Angeles Superior Court to be named Thomas’ guardian, which could take a few weeks to be approved.
Despite the pleas, U.S. Bankruptcy Judge Barry Russell was not swayed. Judge Russel denied Robert’s request and sent “the case to proceed to Chapter 7 bankruptcy.” This means that all of the Girardi Keese law firm’s remaining assets will be liquidated to pay creditors.
Meanwhile, Robert’s guardianship request comes weeks after a criminal defense lawyer for Tom first raised concerns over his cognition.
In December, defense lawyer Evan Jenness told a federal judge in Chicago that Tom “has had issues of his mental competence” and was not able to assist her in completing a response to allegations that he misappropriated more than $2 million from the families of the victims of the 2018 Lion Air plane crash.
Tom’s Girardi Keese law firm, which has been in business since the 60s, seemed to shut down operations late last year. The law firm’s website shut down, and phone calls were left unanswered. Trustees “put in place by the Bankruptcy Court visited the Wilshire Boulevard law practice last week to begin assessing the situation.”
During their visit, they found the office deserted besides Tom, located in his office. According to one of the interim trustees, Elissa Miller said “boxes and boxes of documents” showed “active cases that need representation.”
“I don’t think he really has a handle on the day to day of these cases,” said Miller. She added, “He seemed a bit confused.”
The Real Housewives of Beverly Hills is expected to return for season 11 in mid-2021.
