Joe Giudice has been hit with another setback in his fight for freedom.
The Real Housewives of New Jersey husband’s time extension request in his deportation has been denied! Joe previously requested an extension to file a brief in his deportation appeal. This brief would be a direct response to the Attorney General, who believes Joe should be removed from the United States and sent back to his native Italy immediately.
On September 12, the Third Circuit Court shut down Joe’s extension request. Now Joe will have to submit his reply brief to the court by October 15.
Meanwhile, Joe is still awaiting a decision on his September 11th bond hearing.
In a Pennsylvania court on Wednesday, September 11, Joe’s attorney argued that the 49-year-old should be released from ICE custody on bond while he awaits a decision on his deportation case.
The attorney added that since Joe has been in ICE custody since March he is eligible for release. For the past six months, Joe has called ICE’s Clinton County Correctional Facility in McElhattan, Pennsylvania home.
However, the prosecutor in the case says that Joe’s previous convictions do not make him eligible for release on bond.
“Given his sentence, 41 months in prison, 2 years of supervised release that led him to immigration custody, he is a flight risk and a danger to society,” the prosecutor said. “He has numerous interactions with police. He has a family here and there is reason to believe that he won’t turn himself into ICE custody if he is ordered deported.”
The attorney for Joe then argued for supervised release and promised that his client would cooperate with ICE.
“He just wants to be here with his wife, brother, and family,” he said. “Law enforcement will be monitoring him, plus the media will be following his every move. So I disagree he is a risk flight.”
While the judge said he would make a decision later that day, in a written statement, he has yet to issue a verdict.
