Joe Giudice Fights In Court To Be Released From ICE Custody While He Awaits Deportation Decision

Joe Giudice continues to fight the good fight but this time around he’s fighting to be released from ICE custody. #BRINGJOEHOME

The Real Housewives of New Jersey husband was in a Pennsylvania courtroom on Wednesday, September 11 for a bond hearing.

While Joe wasn’t physically in court, he appeared on video, his very large family including his mother, brother, aunts, uncles, and cousins all came to support him. Despite their support of Joe, they reportedly gave his wife Teresa Giudice the cold shoulder. Joe’s four daughters Gia, Milania, Gabriella, and Audriana did not attend the hearing.

Teresa “arrived separately” from Joe’s family, and “kept to herself.” The RHONJ OG sat near her attorney and did not speak to Joe’s mother, Filomena Giudice, or his brother, Peter.

As for Joe, witnesses say he’s lost about “80 pounds” and looks “sickly, and sad.”

While the alleged Giudice family drama is juicy AF it wasn’t the focus of this hearing.

Joe’s attorney argued that the 49-year-old should be released from ICE custody on bond while he awaits a decision on his deportation case.

The attorney added that since Joe has been in ICE custody since March he is eligible for release. For the past six months, Joe has called ICE’s Clinton County Correctional Facility in McElhattan, Pennsylvania home.

However, the prosecutor in the case says that Joe’s previous convictions do not make him eligible for release on bond.

“Given his sentence, 41 months in prison, 2 years of supervised release that led him to immigration custody, he is a flight risk and a danger to society,” the prosecutor said. “He has numerous interactions with police. He has a family here and there is reason to believe that he won’t turn himself into ICE custody if he is ordered deported.”

The attorney for Joe then argued for supervised release and promised that his client would cooperate with ICE.

“He just wants to be here with his wife, brother, and family,” he said. “Law enforcement will be monitoring him, plus the media will be following his every move. So I disagree he is a risk flight.”

The judge did not make a decision in court but said he will issue a written decision later in the day.

Witnesses claim that Joe’s mom Filomena cried throughout the hearing and had an emotional outburst towards the end.

“We just want him home!” she shouted.

Meanwhile, Teresa visited her mother’s grave the day before her husband’s court date and shared a photo of it on Instagram.

Teresa has previously said that she will divorce Joe if he is deported to Italy.

“I hope that’s not a decision I have to make,” Teresa told host Andy Cohen at the RHONJ reunion in February. “But like, to pick up my children and just move to another country, I don’t think that would be good for my children. So I mean, so no, I probably wouldn’t.”
