The program in question would provide Joe with treatment for drinking but could also shave up to a year off his prison sentence, if completed.
According to sources, a federal judge signed an order allowing Joe’s case to move forward, citing that a dismissal is “not warranted.”
After the victory, Joe’s petition was sent to Civil Division Chief at the United States Attorney’s Office.
Meanwhile, a federal judge gave the U.S. Bureau of Prisons 45 days to respond to Joe’s lawsuit.
The judge also granted Joe 30 days to respond to the U.S.Bureau of Prisons decision once it is received.
The U.S.Bureau of Prisons will be required to file a written notice within seven days from when Joe is released.
Looks like Joe may get into his alcohol treatment program after all! Time will tell.
